1. Service Description

The Service is a software platform intended to support documentation, educational, research, and administrative workflows for healthcare practitioners.

The Service does not provide medical advice, diagnosis, treatment, or clinical decision support.

2. Eligibility

By using the Service, you represent that:

  • You are a licensed or authorized healthcare practitioner (where applicable)
  • You have authority to upload information processed through the Service
  • You are legally permitted to use the Service in your jurisdiction

3. FDA Non-Device CDS Classification

Hlistix is classified as Non-Device Clinical Decision Support (CDS) under the 21st Century Cures Act (Section 3060(a)).

This platform is NOT a medical device as defined by the FDA. Hlistix meets all four statutory criteria for Non-Device CDS:

  1. No Images/Signals: Does not acquire, process, or analyze medical images, signals, or patterns from in vitro diagnostic devices
  2. Information Display Only: Only displays or provides medical information, clinical research, and evidence-based professional guidelines
  3. Non-Directive: Does not direct, recommend, or mandate specific clinical actions — all information is presented for consideration only
  4. Independent Review: Enables the healthcare professional to independently review the basis for any presented information or recommendations
Clinical Responsibility Acknowledgment

The Service is designed as a clinical research aggregation and decision-support tool. It is NOT intended to diagnose, treat, cure, or prevent any disease. By using this platform, you acknowledge:

  • The platform supports but does NOT replace independent clinical judgment
  • The platform does NOT automate or direct patient care decisions
  • All clinical decisions remain your sole responsibility as a licensed practitioner
  • Information is provided for educational and informational purposes only

Healthcare practitioners are solely responsible for their clinical decisions and patient care. Always use professional judgment and consider individual patient circumstances.

4. Practitioner Responsibilities

You acknowledge and agree that:

  • You are solely responsible for all data you upload
  • You have obtained all required patient consents
  • You determine whether data constitutes PHI or sensitive personal data
  • You are responsible for compliance with all applicable laws and regulations

5. No Clinical Reliance

The Service:

  • Does not replace professional judgment
  • Must not be relied upon for diagnosis or treatment decisions
  • Is not intended for emergency or real-time medical use

6. Data Accuracy

Hlistix does not verify:

  • Accuracy of patient information
  • Completeness of documentation
  • Clinical appropriateness of practitioner notes or recommendations

7. Limitation of Liability

To the maximum extent permitted by law:

  • Hlistix shall not be liable for indirect, incidental, or consequential damages
  • Hlistix shall not be liable for clinical outcomes, patient harm, or regulatory violations arising from user actions

8. Indemnification

You agree to indemnify and hold harmless Hlistix from any claims arising out of:

  • Data uploaded by you
  • Your professional services
  • Your violation of applicable laws or regulations

9. Suspension and Termination

Access may be suspended or terminated for:

  • Violation of these Terms
  • Misuse of the Service
  • Legal or regulatory risk

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Israel.

Exclusive jurisdiction shall lie with the competent courts in Tel Aviv–Jaffa, Israel.
