1. Acceptance of Terms

By accessing or using Hlistix ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Hlistix is a clinical research aggregation and decision-support platform that provides:

  • Access to clinical research database
  • Treatment protocol information
  • Practice management tools
  • Analytics and reporting features

3. FDA Non-Device CDS Classification

Hlistix is classified as Non-Device Clinical Decision Support (CDS) under the 21st Century Cures Act (Section 3060(a)).

This platform is NOT a medical device as defined by the FDA. Hlistix meets all four statutory criteria for Non-Device CDS:

  1. No Images/Signals: Does not acquire, process, or analyze medical images, signals, or patterns from in vitro diagnostic devices
  2. Information Display Only: Only displays or provides medical information, clinical research, and evidence-based professional guidelines
  3. Non-Directive: Does not direct, recommend, or mandate specific clinical actions - all information is presented for consideration only
  4. Independent Review: Enables the healthcare professional to independently review the basis for any presented information or recommendations
Clinical Responsibility Acknowledgment

The Service is designed as a clinical research aggregation and decision-support tool. It is NOT intended to diagnose, treat, cure, or prevent any disease. By using this platform, you acknowledge:

  • The platform supports but does NOT replace independent clinical judgment
  • The platform does NOT automate or direct patient care decisions
  • All clinical decisions remain your sole responsibility as a licensed practitioner
  • Information is provided for educational and informational purposes only

Healthcare practitioners are solely responsible for their clinical decisions and patient care. Always use professional judgment and consider individual patient circumstances.

4. User Accounts

4.1 Account Creation

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Notify us immediately of unauthorized access
  • Accept responsibility for all activities under your account
4.2 Practitioner Verification

Practitioner and Clinic accounts require credential verification. You agree to provide valid professional licenses or certifications. Misrepresentation of credentials may result in account termination.

5. Subscription and Payment

5.1 Billing

Subscriptions are billed in advance on a monthly basis through our payment processor, Paddle. By subscribing, you authorize recurring charges to your payment method.

5.2 Cancellation

You may cancel your subscription at any time. Access continues until the end of your current billing period.

5.3 Refunds

We offer a 30-day money-back guarantee for new subscribers. Contact support for refund requests.

6. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Share your account credentials with others
  • Attempt to gain unauthorized access to the Service
  • Scrape, crawl, or automatically extract data
  • Interfere with the proper functioning of the Service
  • Redistribute or resell access to the Service

7. Intellectual Property

The Service and its content are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without permission.

Clinical research content is sourced from public databases and is subject to their respective terms and licenses.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HLISTIX AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PRECEDING 12 MONTHS.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify you of material changes via email or in-app notification.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
